FRANCE: New divorce legislation cuts contentious cases


The number of contentious divorce cases in France has decreased since Law No. 2019-222 came into force on 1 January 2021.

Instead of a two-step process including an initial conciliation stage and summons stage, the procedure is now initiated by a single judicial act, either a summons or a joint petition, setting out both the claims on the merits and the requests for interim measures.

Personal appearances by both spouses are no longer mandatory, and there is an option to waive the setting of interim measures, although disparities have appeared in the way each family court manages the new process.
